Ashling
customers may purchase an optional Software Update Service Agreement
for periods of 1 year, subject to the additional conditions
set down below.

The
Software Update Service includes standard upgrades to correct
software defects and replacement of faulty program disks supplied
by Ashling, where the defect is caused by Ashling's workmanship
or by defective materials.

The
Software Update Service Agreement entitles the holder to automatic
updates, free of charge, including all software performance
improvements, all enhancements to existing features and all
additions of new features that are made to the product covered
by the Agreement. New features which enter the Ashling Product
Catalogue as separately priced products are not included.

The
Software Update Service includes the supply of Application Notes,
Newsletters and telephone application support. The agreement
further entitles the holder to submit formal requests to Ashling
for change and improvements to those products covered by this
agreement. Ashling undertakes to evaluate such changes and if
so requested, to quote for their implementation where it is
deemed to be feasible.

All
Ashling software products are covered by copyright vested in
Ashling. Customers may duplicate Ashling's software for backup
purposes only. Unauthorised copying of Ashling software violates
Ashling's copyright and voids the customer's Software Update
Service Agreement.

The
cost of the Software Update Service Agreement is 30% of the
current list price of each of the products to be covered, (excluding
VAT and shipping costs etc.) a quotation is available from your
nearest Ashling office or distributor.
Please note that where your previous period of Warranty or
Software Update Service cover has been allowed to lapse you
will be required to pay an additional 10% discontinuity fee
or you may choose to have your new agreement backdated to the
expiry date of your previous cover.

Ashling's liability under this agreement is limited to the repair
or replacement of the Ashling product, whichever is appropriate.
Ashling is not responsible for any loss of profits, loss of
use, interruption of business, nor for indirect, special, incidental
or consequential damages of any kind whether under this agreement
or otherwise.
